fREELANCE DIGITAL ARTIST AND ANIMATOR

TERMS OF SERVICE

If you commission me, you agree with the following terms.

Payment

  • I accept payment through PayPal only.

  • The communication with the clients is going to happen, most preferably, through e-mail

  • The Payment will be first before I start working on the requested artwork.

  • I have the right to accept or refuse your commission.

  • Do NOT send the payment before I accept your commission, or before I send an invoice myself.

  • I only accept full payment and not in portions.

  • In order for me to avoid high conversion fees, my invoices will be in EUR (€). I will be using Google's USD/EUR converter.

  • I will not reduce the actual prices of my commissions or make discounts.

  • I will send to your e-mail an invoice through PayPal so that the payment can be sent.

Copyright and Usage

As the artist:
I reserve the right to cancel and refund the order at any time for any reason.

  • I retain all copyrights over the commissioned artwork.

  • I will NOT claim the intellectual property (IP) of the commissioned artwork.

  • I reserve the right to post the commissioned artwork online, in my portfolio. If the client requests for the commission to be private and not publicly displayed, their wish will be respected.

You (the customer/commissioner):

  • You may upload the commissioned artwork on any website and social channels.

  • You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.) without paid agreement.

  • You may NOT alter the commissioned artwork without my (the artist's) consent.

  • You retain the rights to the intellectual property (IP).

  • You may NOT use the commissioned artwork for commercial purposes.

The following is considered Copyright Infringement:

  • Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.

  • Claiming the artwork as your own.

  • Altering the artwork without my consent.

DRAWING

  • A preview sketch is going to be provided to the client after I receive the payment.

  • I have a list on Trello.com where I update the status of all commissions, I'll give the link to the customer       after I send the sketch.

  • Before the delivery of the final product, I will send a watermarked preview in a low resolution for approval.

  • The final product will be a PNG file in 4K (3840 x 2160) resolution.

  • All the corrections of any possible mistakes are going to be made during the sketch progress.

  • If any mistakes in the finalized commission are a result of a misunderstanding between myself and a client,
then I will alter the project at no additional charge.

  • The maximum number of minor changes per sketch is going to be limited to 5, so the client has to be very specific about what they want. If I am asked to change the sketch entirely, it will be charged as a completely different commission.

  • I charge an additional fee for any changes that have to be made to projects based on a client's personal preference, following delivery.

3d modelinG

  • My models are designed for NPR (Non-Photorealistic Rendering) style.

  • I do not accept licensed 3D character commissions per request, but characters that belong to the clients.

  • A model-sheet of the requested character is going to be provided to the client after I receive the payment.

  • All the corrections of the design are going to be made during the model-sheet progress.

  • I will not accept any changes once the model-sheet has been approved by the client.

  • I use Blender 3D to render my NPR models and I have my own unique shaders, so the results might vary, depending on the engine and the shaders the client uses.

  • I have a list on Trello.com where I update the status of all commissions, I'll give the link to the customer.

  • I will send a RAR file which will contain both the final FBX file and the Texture (PNG) in 4096 x 4096 resolution.

  • If the client notices any glitches on the model by using Blender 3D, I will try to reproduce the problem and solve it. Such process will require screenshots and a detailed description of the issue.

  • If the model works well in the Blender 3D environment, but shows issues in other engines, I have no power to fix it since I won't be able to reproduce the problem.

  • The only models directly distributed to the clients will be of their own original characters.

  • Models of licensed characters will be available on my page on SketchFab.com for mass distribution.

animation

  • I do not take 2D character Animation commissions. Some additional effects can still be in 2D style.

  • My character Animations are all strictly 3D NPR (Non-Photorealistic Rendering), so the client would have to request for a 3D model of their own character.

  •  Animation commissions of licensed characters can only be done if the said models have already been created. I will upload, on my SketchFab.com page, all the 3D models of the licensed characters that I've made so far.

  • An animatic of rough sketches will be provided to the client after I receive the payment.

  • All the corrections of any possible mistakes are going to be made during the animatic progress.

  • If a 3D model is purchased, it can still be used for future Animation commissions. The client only pays once for the 3D model.

  • The client would have to specify to me how many sequences they want and how many seconds each sequence should have.

  • I have a list on Trello.com where I update the status of all commissions, I'll give the link to the customer.

  • If the client provides sound effects, their addition to the final composition will be free of charge.

  • The final product will be in either MP4 format in 4K (3840 x 2160) resolution or a GIF format (1000 x 563) depending on what the client asks for.

  • If the client has requested for an MP4 film, and they would like for me to convert some sequences to short GIF files, that would be free of charge.

Cancelation and refund policy

  • The buyer is not allowed a refund once I start working on the commission.

  • If for any reason I am unable to start your commission you will receive a full refund.

  • If the buyer cancels their order before I start it, they can get a full refund.
